PRIVACY POLICY

Last updated: December 2015 This Privacy Policy sets out the privacy policies and practices for Uni-Select Inc. (“Uni-Select”) with respect to the collection, use and disclosure of personal information, including in respect of the www.gopurezone.com web site (the “Site”). We may add additional sites from time to time as we expand our product offerings and this Privacy Policy will govern those new sites. You may be accessing our Site from a computer or mobile phone device (for example, through an iPhone or iPad application) and this policy governs your use of our Site regardless of the means of access. Uni-Select may update this Privacy Policy upon reasonable notice (including by email or by posting on this Site).

 

Personal Information

“Personal Information” is information that identifies you as an individual. Types of Personal Information we collect may include:

  • Telephone number (including home and mobile phone numbers)

Collection of Personal Information

We only collect Personal Information when you voluntarily submit it to us or voluntarily register on our email alert list. You may not be able to receive emails from Uni-Select unless you voluntarily register with us.

We may also collect information in connection with your visit to our Site through the use of cookies. Such information will be used to analyze trends, to administer the Site, to track visitors’ movements around the Site and to gather demographic information about our visitor base as a whole. The use of cookies merely identifies you as a number, that is, your name, address or any other information that directly identifies you will not be collected. How your Personal Information is used

Uni-Select collects Personal Information to send email alerts. We usually use this Personal Information for internal purposes, such as studying the personal preferences of users of the Site.

 

Disclosure of Personal Information

We share the Personal Information we collect with the subsidiaries and affiliates of Uni-Select.

Uni-Select will transfer or otherwise disclose the information it collects from Uni-Select Site visitors to employees and independent contractors of Uni-Select, its parent corporation, subsidiaries, affiliates and service providers if the disclosure will enable that party to perform a business, professional, analytical or technical support function for Uni-Select or if required to do so by law. In the event that another company purchases the assets or stock of Uni-Select, its parent corporation, subsidiaries or affiliates, your Personal Information may become the property of another entity.

 

Retention and Protection of Files Containing Personal Information

We will use, disclose or retain your Personal Information for as long as necessary to fulfill the purposes for which that Personal Information was collected and as permitted or required by law. Personal Information collected from you is processed and backed up on a secured server.

However, even though Uni-Select has put in place mechanisms and procedures to ensure the protection of your personal information that are considered to be effective, we cannot guarantee that such information will not be lost, used unlawfully or modified in a fraudulent manner since no data transmission over the Internet can be guaranteed to be completely confidential. Consequently, Uni- Select bears no liability for the use that may be made of the information by you or a third party.

 

Providing Access

We will give you access to the information we retain within a reasonable timeframe, upon written request, satisfactory identification and proof of entitlement. If you find any errors in the Personal Information retained by us, we urge you to contact us as soon as possible and we will make the appropriate corrections immediately, based on receipt of satisfactory evidence.

You may challenge our decision.

 

Opt-Out

You may opt out of receiving electronic mail by forwarding your request in writing to: questions@uniselect.com (with a cc to legal@uniselect.com)

We may request that you provide satisfactory identification to permit access to the existence, use or disclosure of your Personal Information. Any such identifying information shall be used only for this purpose. We will attempt to respond to each of your written requests not later than thirty (30) days after receipt of such requests.

We will advise you in writing if we cannot meet your requests within this time limit.

 

E-mail Security

“Phishing” is a scam designed to steal your Personal Information. If you receive an email that looks like it is from us asking for your Personal Information, do not respond. We will never request your password, user name, credit card information or other Personal information through email.

 

California Residents

If you are a California resident and have an established business relationship with us, you can request a notice disclosing the categories of Personal Information we have shared with third parties, for the third parties’ direct marketing purposes, during the preceding calendar year. Children’s Personal Information

We recognize the particular importance of protecting privacy where children are concerned. We do not knowingly collect personally identifiable information online from children under the age of 13. Changes to our Privacy Policy

We will occasionally update our Privacy Policy to reflect customer feedback and changes in our services. Use of Technology: Cookies & Logs

As previously mentioned, Uni-Select may use cookies to collect information about its visitors. Cookies are identifiers that are transferred to your computer’s hard drive through your Web browser to enable our systems to recognize your browser.

You may choose to disable cookies on your computer by modifying your Web browser. Uni-Select may also use logs to collect information about its visitors. Uni-Select may review server logs for security purposes, for example, to detect intrusions into our network. Server log data, which contains visitors’ IP addresses, could in instances of criminal malfeasance be used to trace and identify individuals. In such instances, raw data logs would be shared with appropriate investigative bodies authorized to investigate such breaches of security. Like cookies, logs do not cross reference the information automatically collected with any type of personal information that is voluntarily offered by you on or through this Site.

 

Governing Law, Arbitration and Evidence

This Site is controlled and operated by Uni-Select from Québec, Canada and these terms shall be governed by the laws of the Province of Québec and the laws of Canada applicable thereto without reference to principles of conflict of laws. You agree to be bound by such laws.

Any dispute, controversy or claim arising out of or in connection with these terms or the use of this Site, including any matters regarding the invalidity or application of the terms of use, shall be referred to and finally resolved by the arbitration in the city of Montréal, Québec, in accordance with the provisions of Book VII of the Code of Civil Procedure of the Province of Québec. The arbitral tribunal shall be composed of one arbitrator. The language of the arbitration shall be French unless you prefer to conduct arbitration procedures in English and you have advised Uni-Select in due course. The arbitrator’s award shall be final and binding on all parties and judgment on the award may be entered and the award enforced in any court having jurisdiction thereof. Page 5 of 5

Notwithstanding the foregoing, nothing contained herein shall be interpreted as precluding Uni-Select from exercising any extraordinary procedures under the Code of Civil Procedure of the Province of Québec, such as an injunction.

 

Consent

By providing your Personal Information to Uni-Select, you recognize that you have consented, expressly, freely and in full awareness to the collection, use and disclosure of your Personal Information by Uni- Select for the purposes specified in this Privacy Policy or otherwise as identified to you at the time of collection of the Personal Information.
